1. Acceptance of Terms

By accessing or using HeyCarlton ("the Service"), you agree to be bound by these Terms of Service. If you don't agree, please don't use the Service. These terms apply to all users, including those on the waitlist, free trials, and paid subscriptions.

2. Description of Service

HeyCarlton provides a personal AI agent designed to help families manage schedules, deadlines, reminders, and daily logistics. The Service includes:

• A personal AI agent that runs on dedicated infrastructure for your family
• Integration with third-party services you choose to connect (calendars, email, etc.)
• Proactive notifications, briefings, and management features
• A web-based interface and messaging-based interaction

We're continuously improving HeyCarlton. Features may be added, modified, or removed as the product evolves. We'll always communicate significant changes in advance.

3. Account Terms

To use HeyCarlton, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Keep your account credentials secure
• Accept responsibility for all activity under your account

You may create one account per family. Each account includes one AI agent instance. You are responsible for ensuring that your use of the Service complies with all applicable laws.

4. Acceptable Use

You agree not to:

• Use HeyCarlton for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with unauthorized third parties
• Use the Service to harm, harass, or exploit others
• Attempt to access other users' data or instances

5. Intellectual Property

HeyCarlton, including its design, code, AI models, and brand assets, is owned by HeyCarlton. You retain full ownership of all data and content you provide to the Service. We claim no intellectual property rights over your family's information.

The name you give your personal agent is yours. We won't use it for marketing without your explicit permission.

6. Payment Terms

HeyCarlton offers paid subscription plans billed monthly. By subscribing, you agree to:

• Pay the applicable monthly fee on each billing cycle
• Provide valid payment information
• Accept that founder's pricing ($29/month) is locked at the rate at the time of your initial subscription and will not increase
• Accept that regular pricing may be adjusted with 30 days' notice

All fees are in US Dollars. Payments are processed by our third-party payment provider. We do not store your credit card details directly.

7. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You will retain access to the Service through the end of your current billing period
• No further charges will be made to your payment method
• Your data will be permanently deleted within 30 days of your subscription ending (unless you request immediate deletion)

If you cancel and later wish to resubscribe, you'll be charged the current rate at the time of resubscription (founder's pricing is not transferable after cancellation).

8. Limitation of Liability

HeyCarlton is provided "as is." While we work hard to make the Service reliable and accurate, we cannot guarantee that:

• The Service will be available 100% of the time
• All AI-generated information will be perfectly accurate
• The Service will meet every specific requirement you may have

To the maximum extent permitted by law, HeyCarlton's total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Disclaimers

HeyCarlton is an AI-powered tool designed to assist with family management. It is not a substitute for professional advice in medical, legal, financial, or educational matters. Always use your own judgment for important decisions, especially those involving your children's wellbeing and safety.

AI systems can make mistakes. While we strive for accuracy, you should verify critical information (deadlines, appointments, medical information) independently.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, binding arbitration.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you via email at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
